Trooper involved in Kashmiri killing applies for bail
SRINAGAR, (SANA): Border Security Force (BSF) Commandant R K Birdhi, who is facing arrest in connection with the killing of a 16-year-old boy and had applied for anticipatory bail, did not appear before the Sessions court for the proceedings which were postponed till tomorrow.
Birdhi, through his counsel Moulvi Aijaz Ahmad, had filed an anticipatory bail application before the first additional District and Sessions Judge Shakti Gupta here as he was apprehending arrest in connection with the killing of Zahid Farooq in BSF firing on February 5 at Nishat.
However, neither Birdhi nor his counsel was present in the court when the application came up for hearing at around 12 noon.
The Judge adjourned the case for half an hour after another lawyer informed the court that the counsel for the BSF officer had called him over telephone to plead for some more time to appear as he was on his way.
However, the petitioner and the counsel failed to appear before the court even after one hour, forcing the Judge to postpone the case till afternoon session. The court finally adjourned the case till tomorrow as Birdhi and Moulvi Aijaz failed to appear even in the post-lunch session.
“In order to meet the ends of justice, the circumstances of the case require that before passing any adverse orders in the petition today the presence of the petitioner and his counsel is awaited for a reasonable time. The matter is adjourned and let the file come up tomorrow,” Gupta ordered.
A team of Kashmir Bar Association submitted before the court that they would like to assist the court in the proceedings of the case. The court allowed the Bar team to argue the case as Additional Public Prosecutor informed the court that he did not have any objections to it.
